Terms of Use

Welcome to FlowShift. These Terms of Use ("Terms") govern your access to and use of the FlowShift Manager and FlowShift Staff mobile applications (the "Apps") and the website at flowshift.work (the "Site"), operated by Pymesoft LLC ("we," "our," or "us").

By downloading, installing, or using our Apps or Site, you agree to be bound by these Terms. If you do not agree, do not use our services.

FlowShift is an event staffing platform that enables managers to create events, assign staff, track attendance, and manage payroll, and enables staff to view shifts, accept or decline events, track hours, and manage earnings. The service includes AI-powered assistant features, push notifications, and real-time communication between managers and staff.

To use FlowShift, you must create an account using Google Sign-In, Apple Sign-In, phone authentication, or email and password. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.

You must be at least 16 years of age to create an account and use our services.

Free Tier

FlowShift offers a free tier with limited features, including 5 AI credits per month and up to 3 personal events per month.

Paid Subscriptions

FlowShift offers Plus and Pro subscription tiers with additional features and higher usage limits. Subscription prices are displayed in the app at the time of purchase.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the same price unless you change your subscription plan.

Managing Subscriptions

You can manage or cancel your subscription at any time through your device's account settings (App Store or Google Play). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next billing period following the date of the price change. We will notify you in advance of any price changes. Your continued use of the service after the price change constitutes agreement to pay the updated amount.

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable law
• Impersonate another person or entity or falsify clock-in or attendance records
• Interfere with or disrupt the service or servers connected to the service
• Attempt to gain unauthorized access to any part of the service
• Use automated means (bots, scrapers) to access the service without our written permission
• Transmit harmful, offensive, or inappropriate content through the chat features
• Share your account credentials with others

The FlowShift Apps, Site, and all related content, features, and functionality are owned by Pymesoft LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.

You retain ownership of any content you submit through the Apps, including profile information, chat messages, and work records. By using the service, you grant us a limited license to store, process, and display your content as necessary to provide the service.

Work-related data (shifts, hours, attendance) may be shared with your manager or team administrator as part of the normal staffing workflow.

FlowShift includes an AI-powered assistant that provides shift insights, schedule analysis, and other helpful information. AI responses are generated automatically and may not always be accurate. The AI assistant is provided as a convenience and should not be relied upon for critical employment, financial, or legal decisions.

The Apps may request access to your device's location services for clock-in/clock-out verification. Location data is collected only at the moment of clock-in or clock-out and is not tracked in the background. You may disable location services in your device settings, though this may limit certain features.

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to other users, us, or third parties. You may delete your account at any time by contacting us at [email protected].

Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PYMESOFT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Colorado.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
